Domain Name Registration Service Agreement

 

1. Definitions and Interpretations

 

1.1 "Registered Domain Name" refers to generic Top-Level Domains (gTLDs) and country and region Top-Level Domains (ccTLDs), for which the top-level domain name management institution (or its affiliates or subcontractors participating in the provision of registration management institution services) maintains relevant data in the domain name management institution's database, arranges for such maintenance, or earns income through such maintenance services. The applicant pays 22net website the required amount according to the price and number of domain names to be registered and the duration set by the platform in advance, and then entrusts 22net website to submit the registration application for gTLDs and ccTLDs to the relevant domain name management institutions. Domain names in the database of the domain name management institution are considered registered domain names even if they do not appear in the regional files (e.g., registered but not activated domain names).

 

1.2 "Applicant" refers to individuals (including natural persons, partnerships, sole proprietorships, etc.) or entities (including companies, enterprises, partnerships, institutions, etc.) that entrust Ourdomains Limited (hereinafter referred to as "ourdomains" or "22net website") to act on their behalf in registering domain names with domain name management institutions. If the domain name registration application is confirmed as successfully registered with the domain name management institution, the applicant is the holder of the registered domain name.

 

1.3 "Agent" refers to a third party individual or entity that handles the domain name registration application process on behalf of the applicant.

 

1.4 "gTLDs Generic Top-Level Domains" refers to the top-level domains under the Internet domain name system authorized by ICANN according to the then-effective domain name management institution agreement, excluding country/code Top-Level Domains (ccTLDs) and Internationalized Domain Names (IDN) country/code Top-Level Domains. Examples include .com, .net, .info, etc., supported by the 22net website.

 

1.5 "ccTLDs Country and Region Top-Level Domains" refers to the top-level domains authorized by ICANN according to the then-effective domain name management institution agreement.

 

1.6 "Domain Name Registration Success": Refers to the situation where the domain name registered by the applicant is confirmed by the domain name management institution to have no prior domain name registrant or does not violate any mandatory regulations related to domain name registration, including but not limited to the reserved domain name policy stipulated by ICANN or the domain name management institution, etc. The applicant has paid the domain name registration fee within the specified period and submitted the domain name application materials that meet the regulations, and the domain name management institution grants the user a certain period of ownership of the domain name. The confirmation of whether the domain name registration is successful shall be based on the data of the domain name management institution.

 

1.7 "Domain Name Registration Time": In the case where the domain name management institution has confirmed that the domain name is successfully registered, the applicant agrees to the exact time when all the terms and conditions of this domain name registration service agreement are executed.

 

1.8 "WHOIS": Refers to the system used to query whether a domain name can be registered and detailed information of registered domain names, including DNS servers, domain name registration time, domain name expiration time, and other related information.

 

1.9 "Illegal Activities" refer to actions that violate relevant legal provisions using domain names provided by 22net website for registration services, or previously registered domain names that have been transferred in through the domain names managed under 22net website, and related illegal activities carried out using such domain names.

 

1.10 "WHOIS Accuracy Specification" refers to the WHOIS accuracy specification attached to this agreement, which may be it to ClientHold, and the resolution service for all other national domain names under the applicant's name.

 

4.12 The applicant agrees and accepts the online electronic submission of registration applications and domain name registration-related identity proof materials to the 22net website. Enterprises or other entities of other natures must provide the 22net website with valid business licenses. If the domain name applied for by the applicant requires application materials stipulated by the domain name management institution, and the qualified domain name application registration materials are not provided within the specified period, it will be considered as automatically waiving the registered domain name, and the applicant shall bear all consequences.

 

4.13 The applicant shall properly manage their domain names and agree to comply with the Appendix B 22net website domain name expiration deletion and automatic renewal policy and Appendix C Expired Domain Name Registration Recovery Policy (ERRP) stipulated in this domain name registration service agreement. If the domain name that the applicant is about to renew is managed under the interface of the 22net website's partner, the applicant agrees that the domain name will be automatically transferred to the main interface of 22net Website Limited for subsequent management after the renewal is completed upon submitting the renewal request. Before the domain name expires, the 22net website will remind the applicant to renew the domain name in a timely manner through the following methods:

 

4.13.1 Send expiration renewal reminders to the registered email of the member account and/or the email displayed in the domain WHOIS. The 22net website will remind domain names 30 days, 10 days, 5 days before expiration, and within 5 days after expiration;

 

4.13.2 If the applicant provides complete, true, and accurate email, phone number, etc., the system will remind according to the reminder method you set, except for users who have canceled third-party reminder functions.

 

Note:

 

1) If you decide not to renew, please contact the website's recordal entity to cancel the recordal information of the relevant domain names as soon as possible to avoid unnecessary losses;

 

2) The applicant agrees that for domain names with an expiration date after October 1, 2016, the renewal grace period is 7 days (including gTLDs and cctLDs). If the applicant expresses in writing or electronically within the aforementioned period that they do not wish to renew (including submitting the domain name to the list of gave up the renewal), the 22net website has the right to cancel the domain name; if the applicant does not express in writing within the aforementioned period that they do not wish to renew, and also does not renew, the 22net website has the right to stop the use of the domain name and cancel the domain name or dispose of the domain name in any way on the day the aforementioned period expires.

 

4.14 The applicant agrees to and complies with the following content of ICANN's domain name registration service provider transfer policy:

 

4.14.1 The applicant uses the 22net website's online domain name transfer function to apply for domain name transfer on their own, confirming that the intention to use the online transfer function comes from their true will; they also bear full responsibility for the authenticity and validity of the instructions issued during the use of this service.

 

4.14.2 In response to the European Union's personal data privacy protection regulations, ICANN promulgated interim policy regulations on May 25, 2018. For any gTLD domain names submitted after May 25, 2018, if the WHOIS of the original registrar was hidden when the transfer was submitted, the transfer will only verify the correctness of the transfer password and will not go through the domain name transfer confirmation authorization process. If the WHOIS of the original registrar was not hidden when submitted, the domain name transfer confirmation authorization process will continue, and the applicant can only start the transfer after the authorization is completed. The 22net website will send a domain name transfer confirmation email to the registrant's email in the current domain WHOIS information for transfer authorization within five (5) natural days after receiving the applicant's first domain name transfer request. The applicant must ensure the accuracy of the current domain WHOIS information before submitting the transfer.

 

4.14.3 When the applicant first submits a domain name transfer, they agree to pay the transfer fee and must ensure that the account balance is sufficient before submitting the transfer. After the domain name transfer is successful, the domain name expiration time will be automatically extended by one year.

 

4.14.4 After the applicant has read and agreed to this domain name registration service agreement, the 22net website system will  default to add the status "ClientTransferProhibited" to the domain name. If the applicant applies for a domain name transfer out, our company will default to lift this status; if the applicant does not transfer out but requests to lift this status, please contact the 22net website customer service center or ask questions, and the 22net website will unlock the domain name and provide the transfer password within five (5) natural days after receiving the applicant's unlock request.

 

4.14.5 If the applicant needs to apply for a domain name transfer out, they can log in to their account the application form online, confirming that the intention to use the online transfer-out function comes from their true will; they also bear full responsibility for the authenticity and validity of the instructions issued during the use of this service. The applicant must carefully read the relevant transfer-out reminders. If the domain name transfer-out request applied for by the applicant has not been registered for sixty (60) days arrears the ICANN Uniform Domain Name Dispute Resolution UDRP process the litigation period of the court or is under investigation by relevant law enforcement agencies, government agencies, or other special factors, the applicant's domain name transfer-out request will be rejected.

 

4.14.6 The applicant agrees to the transfer policy terms stipulated in Appendix D of the 22net website.

 

4.15 For any gTLD domain names, the applicant agrees to the then-effective Uniform Domain Name Dispute Resolution Policy UDRP content of ICANN and the UDRP execution-related procedures attached in the appendix. If there are any changes or to ServerHold status by the domain name registration management institution, i.e., the regulation of the Ministry of Industry and Information Technology that unauthenticated domains are not resolved.

 

5.2 The 22net website agrees that when processing the personal data collected from the applicant, it will not violate the purposes and other restrictions stated in the notice issued to the applicant according to the aforementioned Article 5.1.

 

5.3 The 22net website agrees to take reasonable precautions to prevent the loss, misuse, unauthorized access or disclosure, alteration, or destruction of personal data. Keep the applicant's sensitive information such as identity card numbers, identity card scans, phone numbers, etc., submitted by the applicant according to Article 5.1.3 confidential.

 

5.4 The 22net website handles the domain name registration application procedures for the applicant, submits the required documents, and pays the relevant fees on behalf of the applicant. The 22net website does not guarantee in any explicit or implicit way that the domain name applied for by the user can be successfully registered.

 

5.5 The 22net website does not assume any responsibility for domain name registration disputes caused by domain name management institutions and the following situations:

 

5.5.1 When the applicant fills in the domain name registration application form online, the domain name is registered by others;

 

5.5.2 The domain name is registered by others due to telecommunication line and equipment issues;

 

5.5.3 The registration application may be rejected by the domain name registration institution due to incomplete information, causing the applied domain name to be registered by others;

 

5.5.4 Incorrect information may cause ownership disputes and  issues;

 

5.5.5 The domain name is registered by others due to the period from the applicant's submission of the registration fee to the 22net website's confirmation of receiving the fee;

 

5.5.6 Registration delays or being registered by others due to the applicant's failure to fill in the application form according to prompts or non-standard filling;

 

5.5.7 The applicant fails to submit domain name registration materials within the specified time limit;

 

5.5.8 Registration failure or delays due to system failures or operational errors of the domain name registration management institution.

 

5.6 For any gTLD domain names, the 22net website will execute the following process for each UDRP litigation procedure:

 

5.6.1 Within two (2) working days of receiving the confirmation request from the domain dispute resolution service provider, provide the relevant information mentioned in the confirmation request and confirm that the dispute is in a domain lock state. The 22net website will notify the relevant domain applicant after the domain is locked. The domain will remain locked throughout the pending UDRP arbitration process. Any the domain name complained of to ClientHold status.

 

4. The applicant guarantees in the principle of honesty and credit that the WHOIS information of the relevant domain name is true, accurate, and complete. If this information changes in the future, especially if there are changes in the contact information of the registrant, domain name administrator, technical contact, or payment contact (such as: communication address, phone, fax, or email), the applicant shall DNS resolution path.

 

3. Redemption grace period

 

3.1 If the domain applicant still has not renewed after the automatic renewal grace period ends, the domain will be the domain applicant refusing the transfer is received.

 

2.1.6 The domain has not been transferred for 60 days since the last transfer. (Except when both the transferor and transferee agree to transfer the domain back and/or as specified in the dispute resolution process)

 

2.1.7 The transfer request will be rejected if the registrant change occurs and the previous domain name holder did not choose not to enter a 60-day lock period before any registrant change request.

 

2.2 If the domain applicant does not have any of the situations from 2.1.1 to 2.1.6 when submitting the domain transfer-out request, then after the application is successful, the system will send the transfer password to the domain applicant's registered email, and the domain status ClientTransferProhibited will be automatically unlocked.

 

2.3 After receiving the transfer password, the domain applicant must submit the transfer password to their designated third-party registration service provider for the transfer-in. After the transfer submission is successful, when the 22net website system detects that the domain is in the transfer process, it will automatically send another domain transfer confirmation email to the domain applicant. The domain applicant must carefully read the email content and confirm that this transfer request is submitted by the domain applicant themselves. If it is not submitted by themselves or if there are any doubts, they must contact the 22net website customer service as soon as possible to cancel this transfer operation. If the domain applicant does not respond within five (5) natural days, this domain transfer will be considered authorized by default.
